МРОТ – в числе приоритетных направлений правительства?

Президент Никос Анастасиадис выступил с инициативой как можно скорее завершить консультации с социальными партнерами, чтобы план введения минимального размера оплаты труда был воплощен в жизнь. При этом Торгово-промышленная палата Кипра месяц назад выступала с рекомендацией повременить с реализацией этого решения.

Консультации вступили в завершающую стадию, но не были закончены из-за внезапной болезни и смерти министра труда Зеты Эмилианиду. Покойный министр проявляла личную заинтересованность в этой реформе, поэтому к финансовой стороне данного вопроса добавляется эмоциональный фактор – довести до конца ее инициативу. В своей прощальной речи на похоронах Эмилианиду президент Никос Анастасиадис сказал такие слова, обращаясь к покойной: «Хочу тебя заверить, что твоя миссия будет завершена введением национальной минимальной заработной платы, родительских отпусков по уходу за ребенком и пенсионной реформой».

Главный вопрос – размер минимальной зарплаты

На последнем этапе консультаций будет окончательно определен объем минимального размера оплаты труда, необходимые для МРОТ часы работы и механизм его корректировки. Дополнительным фактором в вопросе введения МРОТ стало достижение политического соглашения между Европейским парламентом и государствами ЕС по директиве о надлежащей минимальной заработной плате, предложенной Комиссией в октябре 2020 года. Генеральный секретарь профсоюза ПЕО Сотирула Хараламбус и лидер профсоюза СЕК Андреас Мацас заявили изданию «Политис», что европейская директива усиливает их аргументы в пользу минимальной заработной платы, которая должна обеспечить работнику достойный уровень жизни.

Генеральный директор Федерации работодателей и промышленников Михалис Антониу отмечает: достижение политического соглашения по европейской директиве – ожидаемое событие. Генеральный секретарь Торгово-промышленной палаты Кипра Мариос Чаккис, со своей стороны, отметил, что спорными вопросами остаются механизм корректировки заработной платы и определение медианы, которая будет использоваться для расчета минимума. Ранее ТППК выступала с резкой критикой относительно введения этой меры. Эксперты палаты отмечали, что МРОТ еще больше подстегнет инфляцию. Ранее ВК писал о том, что окончательное решение о сроках введения минимального размера оплаты труда должно было быть принято в мае.

Позиция профсоюзов

Глава СЕК Андреас Мацас подчеркивает: позиция профсоюзов усиливается недавним отчетом Европейской комиссии по национальной программе реформ для Кипра, в котором говорится, что ежемесячная минимальная заработная плата в размере 1 000 евро окажет значительное влияние на снижение риска бедности (-10%), особенно бедности работников (-22%), и принесет пользу молодежи и работающим женщинам. Генеральный секретарь СЕК считает само собой разумеющимся, что при определении МРОТ должна учитываться средняя заработная плата полностью занятого сотрудника, что дает более высокую цифру по сравнению с медианой общего заработка, которая включает работников, занятых неполный рабочий день. Стороны исходят из того, что МРОТ должен составлять 60% от средней зарплаты. В 2020 году средний заработок работников на полной ставке составлял 1 573 евро, поэтому, по мнению Мацаса, минимальная заработная плата может составить 943,8 евро.

Компании не справятся с нагрузкой

Михалис Антониу, в свою очередь, согласен, что при определении размера МРОТ следует ориентироваться на 60% от средней зарплаты. Но он необязательно должен составлять эту долю с первого дня, а может быть постепенно к ней приближен. Генеральный секретарь ТППК Мариос Чаккис также выступает за введение минимума ниже 60% от медианы, чтобы дать предприятиям пространство для маневра. Что касается требования ЕС о минимальной сумме в 1 000 евро, Чаккис заявляет: такой МРОТ не по силам кипрским компаниям. Если остальные участники общественного процесса будут настаивать на такой сумме, то консультации зайдут в тупик, говорит он. Опыт Великобритании и Германии свидетельствует в пользу поэтапной модели, при которой нижняя граница начинается с низкого уровня и постепенно повышается.

Директива есть, а методики расчета нет

Важно отметить, что европейская директива о надлежащей минимальной заработной плате не предписывает никакой конкретной методологии ее расчета. Директива рекомендует просто установить четкие и последовательные критерии оценки, например:
― принимать во внимание покупательную способность населения, стоимость жизни, уровень, распределение и темпы роста заработной платы, а также национальную производительность;
― регулярно и своевременно обновлять размер МРОТ;
― создать консультативные органы, в работе которых смогут участвовать заинтересованные стороны;
― обеспечить, чтобы изменения и вычеты из законной минимальной заработной платы соответствовали принципам недискриминации и пропорциональности.

Охват работников будут увеличивать постепенно

Что касается охвата работников коллективными соглашениями, то требуются меры по поощрению коллективных переговоров сторон. Здесь бремя ложится на профсоюзы, которые призваны увеличить число своих членов и, в соответствии с существующим законодательством, требовать заключения трудового контракта. Директива предусматривает, что государства, в которых коллективное соглашение защищает менее 80% рабочей силы, должны разработать план действий по постепенному расширению этого охвата. На Кипре уровень охвата рабочей силы коллективными соглашениями оценивается в 40-45%.

Европейская комиссия считает, что директива поможет защитить заработную плату уязвимых работников, сократить бедность и разрыв в доходах, усилить стимулы к труду. Уменьшая неопределенность в отношении будущих затрат на рабочую силу и улучшая систему установления заработной платы, директива будет способствовать улучшению деловой среды и созданию равных условий для бизнеса. МРОТ также окажет небольшое, но положительное влияние на государственный бюджет за счет увеличения налоговых поступлений и сокращения расходов на соцпособия. Хотя стоимость рабочей силы вырастет, предприятия, особенно малые и средние, выиграют от постепенного и предсказуемого повышения минимальной заработной платы, что улучшит условия ведения бизнеса.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
