Законны ли постоянное тестирование и SafePass: мнение юриста

Юрист Яннос Георгиадис, подавший в суд от имени родителей и требующий прекратить обязательное тестирование школьников, встретился с читателями «Вестника Кипра» и ответил на вопросы.

 

Дело «Родители против правительства»: На Кипре все ученики средней и старшей школы обязаны сдавать тесты каждую неделю для того, чтобы быть допущенными к занятиям. Раньше это требование было необязательным, и те, кто не хотел делать тест, допускались к занятиям онлайн. Но с недавнего времени тесты стали обязательным условием. Яннос Георгиадис подтвердил, что данное требование правительства противоречит действующему законодательству и Конституции страны, а также нарушает права человека. На Кипре существует Закон об инфекционных болезнях, 6-я статья данного Закона предоставляет право Совету министров издавать правила и регулирующие положения для защиты здоровья общества. Однако, для вступления в силу такие правила и регулирующие положения должны быть одобрены Парламентом страны. В случае решения об обязательности тестов этого сделано не было.

Георгиадис отметил, что перед подачей иска его офис подготовил официальное письмо с изложением законов, объясняя, почему действующие требования являются незаконными, непропорциональными, причиняют неудобства детям и нарушают права человека. К сожалению, ответа на это письмо не последовало, вследствие чего офис Георгиадиса подал иск на основе статей относительно нарушения основополагающих прав человека, а также права на получение образования. Слушание этого дела состоится 17 мая. Был также подан запрос на получение временного решения Суда о запрете обязательного тестирования и ношения масок до окончания рассмотрения дела. Георгиадис отметил, что заявление сопровождается результатами исследований и отчетом от экспертов, в которых видно, что из каждых 10 000 тестов у детей только 9 положительные, а смертность в данной группе равна 0. «Правительство должно было провести оценку риска, что не было сделано. Меры излишни и необоснованы для этой возрастной категории.» – утверждает Яннос Георгиадис.

 

Вакцинация детей. В последнее время идут разговоры о том, что Кипр одобрит вакцинацию от COVID-19 для детей 12-15 лет. Могут ли школы настаивать на обязательной вакцинации детей для допуска к занятиям? Отвечая на этот вопрос Яннис Георгиадис отметил, что правительство должно признать незаконность данных мер. В противном случае, единственный способ бороться с этим – через суд, надеясь на справедливое решение.

 

Что делать постоянным резидентам Кипра, сделавшим прививку вакциной, неодобренной Кипром (например, «Спутник-V»)? Несмотря на то, что Кипр решил принимать туристов с России, вакцинированных «Спутником-V», постоянным резидентам Кипра с такой вакциной по-прежнему приходится делать экспресс-тесты для предоставления в качестве Safe-Pass. Георгиадис считает этот шаг дискриминацией, так как у людей, вакцинированных «Спутником-V», есть такие же права на передвижение, как и у тех людей, кто были вакцинированы на Кипре другими вакцинами. Кроме того, правительство не указывает весомых причин предпочтения одних брендов вакцин над другими.

 

В данный момент офис Янноса Георгиадиса готовит второй иск относительно SafePass по просьбе более 100 человек. Цель та же: получить временный запрет на требование предъявления этого документа. Суд на Кипре может длиться годами, до вынесения решения Safe Pass должен быть «заморожен».

Иск готовится на основе нарушения Закона о защите прав и достоинства человека в вопросах, связанных с биомедициной. Никто не имеет право принуждать людей прямо или косвенно к вакцинации. Георгиадис привел статьи вышеуказанного Закона, в которых указано, что любое медицинское лечение (особенно то, которое находится на экспериментальной стадии) должно проводиться с предварительного согласия, и человек должен быть хорошо осведомлен о лечении и его последствиях.

Яннос Георгиадис отметил также, что более 14 000 ученых и 50 000 врачей предлагают альтернативную стратегию борьбы с пандемией COVID-19. Они считают, что основное внимание следует уделять защите наиболее уязвимых членов общества – пожилых людей и людей с серьезными хроническими заболеваниями. Рекомендованный авторами подход изложен в документе под названием «Декларация Грейт Баррингтон» (Great Barrington Declaration).

Георгиадис считает, что бороться можно только юридическими методами, задействуя все рычаги системы правосудия. И поход в суд – это возможность выразить свой протест.

 

Насколько законно штрафовать людей за несоблюдение мер? Что будет, если человек не заплатит штраф.

Яннос Георгиадис ответил, что полиция выписывает штрафы на основании Закона об инфекционных заболеваниях, в котором есть поправка, предоставляющая им такие полномочия. Не надо ругаться с полицейским или просить их что-то подписывать (в сети распространялись тексты различных писем), это только ухудшит ситуацию. Надо спокойно забрать штраф и, если человек не согласен, то имеет право не платить и ждать повестки в суд, где он сможет изложить свою точку зрения. «Как юрист, я считаю, что попытка обвинения доказать нарушение на таком слушании обречена на провал», – сказал Яннос Георгиадис.

    1            Application of terms

    3            Definitions

    In these Terms:

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

     

    6            Disclaimers

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    c any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

    9.2        On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

     

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
