Совет Европы раскритиковал действия Кипра

Совет Европы призвал Кипр к ответу за нарушение прав человека, а именно, за несколько случаев, когда лодки с беженцами, плывущие к берегам острова, просто разворачивали и отправляли обратно. Также у Совета Европы возникли вопросы об условиях содержания беженцев в лагерях и о причинах лишения регистрации некоммерческой организации по помощи беженцам KISA.

В письме на имя министра внутренних дел Никоса Нуриса комиссар Совета Европы по правам человека Дуня Миятович сослалась на «некоторые замечания и опасения, связанные с соблюдением на Кипре прав человека в отношение беженцев, просителей убежища и мигрантов». Комиссар заявила, что она получила несколько сообщений, упоминающих, что лодки с беженцами, включая лиц, которые могли нуждаться в международной защите, были лишены возможности причалить к Кипру и отправлены обратно, «иногда насильственно, без какой-либо возможности для их пассажиров получить доступ к процедуре предоставления убежища».

«Когда людей разворачивают на границе до того, как они прошли процедуру идентификации личности, государства ЕС не могут установить, не подвергаются ли эти люди опасности у себя на родине», – считает Миятович. Она добавила, что такая политика может привести к нарушениям Европейской конвенции по правам человека (ЕКПЧ) и конвенции ООН о беженцах. Она добавила, что коллективные высылки мигрантов запрещены ст. 4 протокола №4 ЕКПЧ «и в принципе неприемлемы». Комиссар настоятельно призвала кипрские власти начать независимое расследование случаев жестокого обращения с людьми со стороны сотрудников сил безопасности во время таких операций. Она также призвала обеспечить полную защиту прав человека на море.

В письме комиссар Миятович также упомянула о тех условия, в которых в центре временного приема беженцев живут просители убежища и мигранты. По словам Миятович, от кипрской омбудсвумен и от комиссара по правам детей она знает о переполненности центра, антисанитарии, трудностях в доступе к медицинским услугам. Она также сообщила, что ее внимание привлекло ограничение свободы передвижения, которое подается как профилактическая антикоронавирусная мера. Миятович настоятельно призвала кипрские власти привести условия проживания в центре приема беженцев «в соответствие со стандартами в области прав человека» и обеспечить, чтобы просители убежища и мигранты имели доступ ко всем необходимым услугам. Она заявила, что содержание в лагере детей без права выхода никогда не отвечает их интересам, их необходимо немедленно выпустить.

Миятович также упомянула о препятствиях, чинимых кипрским некоммерческим организациям, оказывающим поддержку просителям убежища и мигрантам. «Я понимаю, что некоторые из них приостановили свою деятельность в приемных центрах по соображениям безопасности, в то время как другие, включая адвокатов, не имеют доступа в эти помещения», – пишет комиссар. Она также упомянула о снятии с регистрации нескольких неправительственных организаций, включая организацию KISA, которые якобы не выполнили ряд формальных требований в установленные сроки.

В своем официальном ответе министр внутренних дел Никос Нурис изложил причины описанных комиссаром действий его министерства. Что касается случаев, когда лодки с беженцами отправляли обратно в Ливан, то министр объяснил это проблемами, с которыми сталкивается Кипр в связи с прибытием нелегальных мигрантов. Он в очередной раз повторил, что число просителей убежища и лиц, пользующихся международной защитой, составляет на Кипре 4% населения. Нурис пишет, что в течение первых восьми дней сентября 2020 года 10 судов с 347 нелегальными мигрантами отправились из Ливана на Кипр, из-за чего власти республики оперативно начали переговоры с Ливаном, было решено, что шесть судов с ливанскими гражданами следует вернуть. «Кипр предотвратил незаконный въезд ливанских мигрантов, которые не просили международной защиты, и сумел благополучно вернуть их в страну», – пишет министр, отмечая, что в течение 2020 года в общей сложности 682 сирийских и ливанских мигранта прибыли на остров или были обнаружены на море при попытке высадиться, а 210 ливанских граждан, обнаруженных на морских границах, вернулись в Ливан, поскольку они заявили, что их целью был не Кипр, а Италия. «Кипрские власти знают и уважают положения законодательства ЕС, которые были приняты во внимание в ходе переговоров, приведших к соответствующему Соглашению о реадмиссии между Кипром и Ливаном», – сказал Нурис.

Что касается центров приема беженцев, то министр заявил, что причиной сложившейся ситуации стала пандемия коронавируса. Он отметил, что выезд из двух приемных центров – в Пурнаре и Кофину – был запрещен в период действия аналогичных мер для всего населения и что в этот период дети, проживающие в центре Кофину, могли посещать школьные занятия дистанционно. Он добавил, что сотрудники Европейского офиса поддержки беженцев (EASO) и Управления Верховного комиссара ООН по вопросам беженцев продолжали оказывать свою помощь и поддержку в течение всего этого периода. Он также сообщил, что с 3 марта выезд из лагерей Пурнары и Кофину разрешен всем жителям, если они пройдут экспресс-тест на коронавирус, и его результат будет отрицательным. Сейчас в центре «Пурнара» строится безопасная зона для представителей уязвимых категорий, включая несопровождаемых несовершеннолетних.

Что касается снятия с регистрации некоторых неправительственных организаций (далее НПО), то Нурис сослался на закон 2017 года, согласно которому все НПО, созданные и зарегистрированные в соответствии с предыдущим законодательством, должны были внести изменения в свой устав и подготовить финансовые отчеты и предпринять другие предписанные действия к концу декабря 2019 года. Из 6 500 НПО около 3 500 выполнили эти требования в установленный срок, а тем, кто этого не сделал, было предоставлено дополнительное время до октября 2020 года. Около 2 200 НПО, подавляющее большинство из которых сейчас уже неактивно, не выполнили требования, но среди них были и действующие, которые лишились законной возможности вести деятельность. Нурис упомянул, что было подано около 60 апелляций от НПО, и Регистратор компаний отменил решение по 23 делам, в то время как в Верховном суде находится только одно дело. Министр пояснил, что новый закон вводит элементы прозрачности и отчетности деятельности НПО в соответствии как с руководящими принципами Группы разработки финансовых мер борьбы с отмыванием денег (ФАТФ), так и с пятой директивой ЕС по борьбе с отмыванием денег.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    8            Privacy policy

    8.1        You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you. For example, we may need to have your contact information in order to provide you with updates from our Website.

    8.2        The personal information you provide to us is collected and may be used for communicating with you, statistical analysis, the marketing by us of products

    and services to you, credit checks (if necessary), and research and development.

    8.3        We may also collect technical information whenever you log on to, or visit the public version of, our Website. This may include information about the way

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
