Как ужиться с грязной стройкой по соседству

В последние пару десятилетий на Кипре — бум строительства. Обычные дома и небоскребы растут то тут, то там со скоростью света. В погоне за интересными контрактами, муниципальные власти не успевают контролировать экологические вопросы, а обычные жители вынуждены страдать из-за грязных и шумных строек по соседству.

Все мы знаем, как выглядит строительный мусор — битый кирпич, куски металла, стекла и бетона, обломки штукатурки, бумага, остатки краски, куски гипсокартона и керамической плитки.

По степени опасности воздействия на окружающую среду и человека строительный мусор считают наименее опасным. Но никто не учитывает, насколько опасна строительная пыль — вдыхая такую регулярно, можно заработать аллергию.

Ситуация в Евросоюзе и на Кипре

По данным исследований, треть всех отходов в странах Евросоюза — строительный мусор. Большую часть перерабатывают и используют повторно. По данным «Евростата», Дания перерабатывает около 90%, Германия — 85%, Великобритания — 75%, Бельгия — 60%. Но есть и страны, где этим почти никто не занимается — к сожалению, в этот список, наряду с Испанией, Польшей и Грецией, входит и Кипр.

В прошлом десятилетии более 70 компаний Кипра приобрели лицензию на сбор, транспортировку и частичное уничтожение отходов на строительных площадках. К слову сказать, на 2019 год число этих компаний выросло в разы. Они имеют в своём распоряжении специальные контейнеры, мобильные дробилки, которые позволяют измельчить мусор, и устройства досмотра, лицензированные Консультативным советом по системе управления отходами. Многие из этих компаний осуществляют переработку и обработку строительных отходов на специализированных площадках.

Тем не менее, большинство строительного мусора оседает, в лучшем случае, на обычных мусорных свалках. В худшем — попадают в ущелья, русла рек, заброшенные карьеры.

Что обязана делать компания-застройщик на Кипре?

В соответствии с пунктом 5 Закона об управлении отходами от земляных работ, строительства или сноса, владелец проекта, если он не передал по контракту государственному оператору владение произведенными отходами, а также ответственность за сбор и переработку, несёт полную ответственность за строительный мусор и должен перед началом любого проекта:
1. Подготовить комплексный план управления отходами, за реализацию которого он несет полную ответственность;
2. До начала реализации проекта, предоставить компетентному органу банковскую гарантию для обеспечения выполнения его обязательств на основе Комплексного плана управления отходами.

Для выполнения обязательств производитель строительных отходов обязан:
поддерживать и эксплуатировать индивидуальную систему управления отходами
или
участвовать в системе коллективного управления отходами.

Все данные об отходах подрядчиков должны быть в системе управления отходами, после чего эти данные ежегодно отправляются в Департамент окружающей среды.

В настоящее время Министерство сельского хозяйства и защиты окружающей среды — контролирует соблюдению всех пунктов Закона об управлении отходов от земляных работ, строительства и сноса, а также по утилизации.

Кто обязан вывозить строительный мусор?

Представитель «Партии зелёных» в Парламенте Кипра Хараламбос Теопемпту подтвердил, что на стадии планировки проекта, инженеры обязаны подсчитать объём будущих строительных отходов, а затем проинформировать об этом все стороны. На основе этих данных, владелец заключает договор с лицензированным подрядчиков на вывоз и утилизацию мусора.

— Если выявлено загрязнение воды во время строительных или демонтажных работ, кто несёт за это ответственность?
— За сбор и своевременный вывоз мусора, а также за любые загрязнения, произошедшие на стройплощадке или в непосредственной близости от нее, ответственность несёт строительная компания. И граждане вправе сообщать о любых подозрениях на недобросовестную работу исполнителей в Департамент окружающей среды.

— Какой штраф ожидает компанию-нарушителя?
— Зависит от того, кто именно выписывает штраф. Если правонарушение обнаружили представители муниципальной власти, то штраф будет не более 100 евро. А если его выписывает Департамент окружающей среды, то сумма может доходить до 4000 евро в досудебном порядке или до 500 000 евро в случае судебных разбирательств.

Почему Кипр не справляется с отходами строек

«Вестник Кипра» обсудил с Георгией Хаджигеоргиу, представителем Кипрской организации по переработке мусора, главные проблемы острова в этой сфере и то, как улучшить ситуацию со сбором и переработкой.

— Сколько компаний на Кипре действительно соблюдают все правила по сбору, транспортировке и переработке строительных отходов?
— У нас нет точных данных о соблюдении правил переработки, но мы знаем, что из 2250 лицензированных подрядчиков на Кипре всего около 350 являются членами коллективных и индивидуальных систем управления отходами. Выводы делайте сами.

— Куда подрядчики должны отвозить отходы на переработку во время и после проведения строительных работ?
— Сегодня на Кипре открыты семь частных перерабатывающих заводов, готовых принять строительные отходы: Лимассол — Recourse Recovery Cyprus, M.S.(Skyra) Vassas Ltd, MS Waste Management LTD; Никосия — Skyra Lima LTD; Ларнака — Solonas Panagi & Sons LTD; Пафос — Poullas Tsadiotis LTD, Athinodorou Green Energy LTD.

— Как вы думаете, почему на острове столь катастрофическая ситуация с переработкой строительных отходов? В чём реальная причина?
— Их много, но я назову самые главные:
Минимальный осмотр и контроль со стороны компетентных органов. Эффективных проверок подрядчиков и владельцев проектов практически не проводится.
Неполная и недостаточная законодательная база по управлению отходами. Изменениями регламента как раз занялись в правительстве в этом году.
Главный ответственный за управление отходами — владелец проекта не проинформирован должным образом и не знает своих обязательств. Местные архитекторы и инженеры должны донести эту информацию до владельца ещё на стадии проектирования.
Отсутствие стандартов на переработанные материалы и их спецификации в контракте стройподрядчика.

К сожалению, достичь общенациональной цели — к 2020 году перерабатывать около 70% строительного мусора и возвращать его в отрасль — практически невозможно. Особенно, если не бороться с существующими проблемами и не усиливать контроль за исполнением законов.

— Жители Никосии, Лимассола и Ларнаки регулярно жалуются на несанкционированные свалки. Кого необходимо вызывать в случае подобных находок?
— В любых ситуациях, связанных с отходами, пылью или другим загрязнением окружающей среды, нужно сообщать в районные отделения Департамента окружающей среды. Инспектор в кратчайшие сроки приедет на место свалки или строительства и проверит, как утилизируется мусор.

Сбор и переработка — на пользу подрядчику

Закон гласит, что об обязательствах по сбору и переработке строительных отходов владелец проекта должен знать ещё до начала реализации проекта. Почему работа с этим пунктом договора может пойти на пользу подрядчику?
— В кратчайшие сроки освобожденная от мусора стройплощадка снижает расходы на складирование и подвоз новых материалов, упрощает работу персонала и техники, обеспечивает непрерывность работ.
— Переработка отходов стоит дешевле, чем закупка новых стройматериалов. Так, например, отправленные на переработку отходы экономят и денежные средства, и природные материалы. Щебень из бетона сносимых зданий можно снова использовать на стройке.
— Правильная утилизация строительного мусора, если не улучшает, то по крайней мере, не ухудшает ситуацию с экологией.

Изучая ситуацию со строительным мусором и его утилизацией, «Вестник Кипра» пытался пообщаться с представителями крупных строительных компаний острова, но никто из них не стал комментировать существующую проблему.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    3            Definitions

    In these Terms:

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

     

    6            Disclaimers

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    c any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
