МРОТ будет 940 евро

Решением правительства на Кипре с 1 января 2023 года будет установлена минимальная заработная плата в размере 940 евро. Об этом по итогам заседания Кабинета министров заявил министр труда Кирьякос Кушос. Заявление вызвало большой резонанс в обществе.

Сезонные работники уязвимы

Было решено, что в течение первых шести месяцев работы зарплата должна составлять не менее 885 евро, а после полугода – увеличиваться до 940 евро. На практике это, скорее всего, будет означать что сезонные работники в индустрии туризма, например, не будут иметь права на более высокую зарплату и окажутся вынуждены довольствоваться жалованьем в 885 евро.

На кого МРОТ не распространится

Внедрение МРОТ с 1 января необходимо для того, чтобы дать экономике время подготовиться, пояснил Кушос. Требование МРОТ не будет действовать для ряда специальностей: домашних помощников, сотрудников сферы судоходства и работников сельского хозяйства и животноводства, так как предполагается, что работодатель предоставляет им питание и проживание. Также исключаются работники, проходящие подготовку для получения ученой степени или профессиональной квалификации.

Кто от решения выиграет

Тем не менее, Кушос отметил, что около 45 000 человек получат выгоду от введения МРОТ, в некоторых случаях рост зарплаты составит 30%. Однако минимальный размер зарплаты не означает, что те сотрудники, которые получают по контракту или коллективному договору сумму больше, потеряют часть своих доходов – работодатель не сможет сократить размер жалования, обозначенного в коллективном договоре.

Из указа также следует, что введение МРОТ никак не влияет на оплату сверхурочных и работы в праздники и выходные. Нерешенным, однако, остается ключевой вопрос о том, за какое количество рабочих часов в неделю будут платить МРОТ. Кушос в этой связи отмечает: данный вопрос будет обсуждаться консультативным советом по труду в сентябре.

Работник вправе отказаться от питания

В целом, если работодатель предоставляет питание и/или жилье, то он сможет вычесть из МРОТ 15% за первое и 10% – за второе. Работник, в свою очередь, может отказаться от питания и/или проживания, чтобы получать больше денег на руки. На сезонных работников в возрасте до 18 лет будет распространяться МРОТ, сокращенный на 25%. Сезонная работа ограничена двумя месяцами, и МРОТ для этой категории работников не может быть еще больше сокращен. Даже если работодатель предоставляет питание и проживание.

Для МРОТ предусмотрены перерасчеты

Первый пересмотр минимальной заработной платы произойдет 1 января 2024 года. Последующие перерасчеты будут проводиться каждые два года. Эта работа организована при содействии нового комитета, куда войдут три представителя профсоюзов, три представителя организаций работодателей и три эксперта по трудовым вопросам. Они будут консультироваться с советом по труду, который, в свою очередь, уполномочен представлять отчеты Кабинету министров.

Президент Никос Анастасиадис приветствовал решение о введении МРОТ, заявив, что оно окажет поддержку работникам, особенно молодым и уязвимым. «Наряду с другими профильными решениями, подобный шаг работает на укрепление социального государства», – написал президент в твиттере. Глава государства напоминает: это решение – дань уважения покойной Зете Эмилианиду, которая проводила большую работу в указанном направлении.

Профсоюзы не согласны

Профсоюз СЕК поспешил выразить свою обеспокоенность по поводу отсутствия ясности с рабочим графиком, заявив, что это может привести к эксплуатации работников. СЕК также заявил, что надеялся на более высокую минимальную заработную плату – минимум 1000 евро. Общественники обращают внимание на растущее давление, с которым сталкивается население из-за инфляции и стоимости жизни.

Решение о МРОТ в его нынешнем виде раскритиковал профсоюз ПЕО. Участники данного объединения назвали предпринятый шаг односторонним. «Установление минимальной заработной платы без привязки к часам или почасовой оплате труда, по сути, закрепляет и узаконивает нынешние явления неопределенного графика, продления рабочего времени без оплаты сверхурочных. Одновременно это создает возможность оспорить соглашение социальных партнеров 1992 года о 38-часовой рабочей неделе», – сказано в заявлении организации. Тот факт, что правительство оставляет за рамками действия указа большие группы работников, которые особенно уязвимы, также оценивается отрицательно. Наконец, право сокращать минимальную зарплату несовершеннолетних сезонных сотрудников на четверть «дает работодателям возможность при легальном прикрытии использовать молодых людей как дешевую рабочую силу».

Работодатели: установленный МРОТ неоправданно высок

На другом конце спектра мнений находится Федерация работодателей и промышленников, которая считает, что минимальная заработная плата была установлена на слишком высоком уровне. Конкурентоспособность экономики находится под угрозой, считают в федерации. По мнению владельцев бизнеса, 940 евро составляют около 60% от средней заработной платы, в то время как «международные организации, которые исследуют минимальную заработную плату», утверждают, что она должна быть установлена ниже 60% от медианного значения и вводиться постепенно.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
