Увольнение на Кипре: 15 вопросов и ответов

Вопрос обязательств работодателя перед сотрудниками часто становится камнем преткновения и поводом для конфликтов, особенно когда дело касается такой неприятной темы как увольнение. Для того, чтобы суметь себя защитить от несправедливости, необходимо знать свои права и обязанности.

Как и когда работодатель должен предупредить вас об увольнении?
Если работодатель принимает решение уволить сотрудника, то он должен предупредить его об этом заранее. Но, что интересно, срок, за который это предупреждение выносится, зависит от выслуги работника – чем она больше, тем дольше и срок предупреждения об увольнении. А именно, если сотрудник проработал на своей должности менее 6 месяцев, то работодатель может уволить его прямо на месте, без предупреждений и сроков. Если сотрудник занимал свое место от 26 до 51 недели (сроки в законе выражаются в неделях, а не в месяцах), тогда он узнает о своем увольнении за неделю. Если от 51 до 103 недель – за две недели, от 104 до 155 недель – за четыре недели. Если сотрудник трудился от 156 до 207 недель, то уволить его можно только спустя пять недель после предупреждения, от 208 до 259 недель – спустя шесть недель. При нахождении на рабочем месте от 259 до 311 недель увольнение последует через семь недель после предупреждения, а при 312 неделях и больше – через восемь недель.

Должен ли сотрудник предупредить работодателя о желании уволиться?

Аналогичные обязательства перед работодателем имеют и сотрудники, которые собираются увольняться. Если они трудились на рабочем месте от 26 до 51 недели, то предупредить начальника надо за неделю. Если от 52 до 259 недель, то за две недели. А при работе в течение пяти лет (260 недель) и более – за три недели.

Есть ли исключения?

Правила об увольнении не распространяются на беременных, которые не могут быть уволены с момента сообщения о своем положении работодателю вплоть до окончания третьего месяца после выхода из декрета.

В некоторых случаях работодатель не обязан информировать сотрудника о грядущем сокращении и может уволить его прямо на месте. Эти случаи касаются:
— поведения сотрудника, из которого становится ясно, что трудовые отношения не могут больше продолжаться;
— совершения серьезного нарушения или неподобающего поведения сотрудника при исполнении своих служебных обязанностей;
— регулярного или серьезного нарушения правил трудовой деятельности.

Обязан ли сотрудник, которого предупредили о грядущем увольнении, работать оставшееся до увольнения время?

Да, он обязан работать до даты увольнения. Но если он пожелает сам уйти с работы раньше этого срока, то может это сделать без каких-то предупреждений работодателю.
Работодатель может попросить сотрудника не ходить на работу до даты увольнения, но в этом случае он должен оплатить ему все эти дни. Сотрудник, в свою очередь, теряет право на 13 и 14 зарплату.

Каковы права уволенного работника на 13 зарплату, отпуск и выплаты из фонда взаимопомощи?

Уволенный сотрудник имеет право:
получить деньги за весь отработанный до даты увольнения период;
получить компенсацию за оставшийся ежегодный отпуск;
получить аналог 13 и/или 14 зарплаты, когда это прописано в соглашении или если в компании есть такая практика;
получить свои взносы в фонд взаимопомощи (в соответствии с уставом фонда).

Может ли работодатель урезать часть зарплаты работнику, если тот не предупредит его о своем уходе?

Нет, если между работником и работодателем не заключен договор, предписывающий именно такие действия. Работодатель имеет право подать на работника в региональный суд и взыскать с него компенсацию своих расходов.

Обязан ли работодатель выдавать при увольнении какой-либо документ?

Работник может попросить работодателя выпустить письмо с указанием периода работы сотрудника в компании, его обязанностей и причины увольнения. Такое письмо может пригодиться сотруднику при поиске нового места работы.

В случае незаконного увольнения куда может обратиться работник?

Он должен обращаться в суд о трудовых разногласиях (Industrial disputes tribunal) за компенсацией.

В случае незаконного увольнения или сокращения имеет ли работник право на компенсацию вне зависимости от его возраста и стажа?

Сотрудники, которым исполняется 65 лет, не имеют права на компенсацию из-за увольнения. Но они все равно должны получить уведомление о своем увольнении заранее.

В каком случае работник имеет право на выплаты из фонда сокращенных сотрудников (Redundancy fund)?

В случаях, когда его сокращение происходит по следующим причинам:
– работодатель закрыл или намерен закрыть компанию;
– работодатель планирует закрыть отделение компании — в этом случае суд может потребовать от работодателя перевести сотрудников в другое отделение фирмы;
– из-за модернизации или любого изменения на производстве, при котором необходимо сократить сотрудников;
– из-за изменений в продукции, методах ее производства или необходимых навыках трудящихся;
– при реструктуризации компании;
– из-за сложностей с реализацией товаров или кредитной задолженности;
– из-за отсутствия заказов или нехватки сырья;
– из-за отсутствия средств производства;
– из-за сокращения объемов работ.

Может ли сотрудник на испытательном сроке быть уволен или уволиться без предупреждения?

Да, при испытательном сроке увольнение происходит без предупреждения как со стороны работодателя, так и со стороны самого сотрудника.

Может ли работодатель выпустить предупреждение об увольнении в то время, когда сотрудник находится на больничном?

Нет, если работник на официальном больничном менее 12 месяцев, то он не может быть уволен весь этот срок плюс 1/4 от продолжительности больничного. Например, если сотрудник болел восемь месяцев, то работодатель не может его уволить в течение 10 месяцев с начала больничного.

Может ли совпадать уведомление об увольнении с больничным или отпуском?

Сроки увольнения не должны полностью или частично совпадать с датами отпуска.
В случае больничного срок увольнения не переносится. Поводом сдвинуть даты увольнения может быть только производственная травма.

Может ли работодатель выпустить предупреждение об увольнении, пока сотрудник находится в декрете или отпуске по экстренным обстоятельствам?

Декретный отпуск или отпуск по экстренным обстоятельствам не могут быть поводом к увольнению и не прерывают стаж. Работодатель не может увольнять или выпускать уведомление об увольнении сотрудника с момента подачи им заявления на декретный отпуск или отпуск по экстренным  обстоятельствам и вплоть до конца декрета или отпуска. Исключение составляют следующие случаи:
– сотрудник виновен в серьезном должностном преступлении или ведет себя так, что прекращение трудовых отношений оправданно;
– компания прекратила свою деятельность;
– закончился срок трудового договора.

Считаются ли выходные при выпуске предупреждения об увольнении?

Да, выходные тоже включены в срок, указанный в предупреждении об увольнении.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    1.2        If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.

     

    2            Changes

    2.1        We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are       responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the Website, you agree to be bound by the changed

    Terms.

    2.2        We may change, suspend, discontinue, or restrict access to, the Website without notice or liability.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    Website means https://vkcyprus.com/

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
