Автоматизация сбора и хранения данных, блокчейн и криптовалюты – эти темы актуальны не только для финтех-компаний. Новейшие технологии оказывают огромное влияние на бизнес-процессы и требуют законодательного регулирования. Самые разные аспекты работы юристов в новых реалиях стали основными темами ежегодной конференции Best Legal.

Сегодня, 26 сентября, в отеле St. Raphael на конференции встретились руководители юридических компаний, председатели профильных ассоциаций и объединений, предприниматели и управляющие компаний, работающих в сфере международного бизнеса, руководители деловых ассоциаций, кипрские юристы, аудиторы и банкиры.

Организатором конференции выступил деловой журнал «Успешный бизнес», модератором – его издатель и главный редактор Наталия Кардаш.

Конференция Best Legal давно стала ведущей площадкой для обсуждения актуальных вопросов, стоящих перед современным международным юридическим сообществом. Мир постоянно меняющихся технологий диктует свои правила, юридические аспекты бизнес-процессов в новых реалиях требуют законодательного регулирования и разъяснения. Эти важные вопросы стали основной темой утренней сессии Best Legal.

Конференцию открыло выступление Христодулоса Дамиану, генерального директора компании Eurofast. Докладчик сделал обзор последних изменений кипрских и международных нормативно-правовых актов, которые оказывают влияние на деловую жизнь Кипра.

Далее участники конференции подробно обсудили влияние новых технологий на работу юристов, аудиторов и бизнесменов, законодательные аспекты автоматизации сбора и хранения данных, а также применения технологии блокчейн и криптовалют.

Бизнес-консультант Филиппос Аристотелус рассказал о новых моделях ведения бизнеса, которые сегодня необходимы профессиональным фирмам, чтобы создать и сохранить свое конкурентное преимущество: «Если у вас есть бизнес, то вы не можете подходить к нему только с точки зрения романтики и думать, что люди будут всегда покупать ваш товар или пользоваться вашими услугами. Вы должны подстраиваться под современный мир, чтобы вас не смыло цунами технологических изменений. Способность постоянно эволюционировать — самый важный фактор развития. Совсем скоро 50% всей деятельности юристов, аудиторов, консультантов будут автоматизированы: поиск информации, составление договоров и другая рутина. В цене останутся эмоциональный интеллект, решение сложных проблем, глубокая экспертиза и конечно, личное общение. Не бойтесь новых технологий, а приручите их — поставьте их на службу вашему бизнесу и развивайте те личные навыки, которые пока неподвластны цифровизации».

Технология блокчейн не просто развивается, но и внедряется в корпоративные бизнес-процессы и системы государственного управления.

Маринос Фемистоклеус, заместитель декана факультета предпринимательства и один из директоров Института будущего (IFF) Университета Никосии, разъяснил официальную позицию Кипра в отношении блокчейн и рассказал о национальной стратегии по внедрению этой технологии: «Блокчейн — это распределенная база данных, копии которой хранятся на миллионе компьютеров по всему миру, они синхронизированы. Данные можно только добавлять, а вот манипулировать ими или удалять их невозможно. Можно сказать, что блокчейн — это новый интернет доверия. Наше законодательство должно быть подготовлено к новым технологиям и соответствовать ему. Правительство Кипра разработало стратегию, благодаря которой страна может стать центром блокчейн-технологии в регионе. Осталось решить проблемы дефицита стандартов, незрелость самой технологии и наладить систему проверки данных».

Председатель Кипрской комиссии по ценным бумагам и биржам Димитра Калогиру ознакомила присутствующих с новыми правилами, процедурами и циркулярами в сфере FinTech, а также представила прогноз регулятора на ближайшие полгода: «За последние десять лет увеличилось количество финтех-компаний, они помогают развивать экономику Кипра, создают новые рабочие места. Технологии меняются так быстро, что регуляторы порой не успевают за ними. Наша задача «держать руку на пульсе» — законодательство должно обеспечивать прозрачность всех процессов и, с другой стороны, защищать интересы инвесторов».

Вопросы защиты персональных данных, обеспечиваемой общим регламентом ЕС и законодательством о банковской тайне, а также правовой защиты активов на Кипре стали предметом доклада Агиса Георгиадиса, партнера Christos Georgiades & Associates LLC: «Многие держат свои капиталы на Кипре, и мы сделали все, чтобы наша юрисдикция оставалась привлекательной. Но мы сталкиваемся с манипулированием акционерами и выводом средств. Способы защиты активов есть, и самые главные из них — стратегическое планирование, продуманные структуры и предварительная оценка рисков».

    1            Application of terms

    3            Definitions

    In these Terms:

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
