Экспресс-тесты для сотрудников незаконны?

Законно ли требовать обязательный экспресс-тест от сотрудников? Некоторые юристы утверждают, что такое требование нарушает Конституцию и основные права человека, другие говорят, что обязательное тестирование может быть законным при определенных условиях.

«Никакие ограничения прав личности нельзя установить министерским декретом, но только законодательными актами, принятыми парламентом», — считает глава Ассоциации адвокатов Христос Клиридис, добавляя, что управление страной с помощью декретов в принципе незаконно и неконституционно. «Вмешательство в права личности допускается только на основании закона, но никак не декрета, имеющего силу закона», — говорит он.

Напомним, с 1 февраля сотрудники, которые физически присутствуют на рабочем месте, должны иметь отрицательный результат теста на коронавирус. На предприятиях, где работает до трех человек, все каждую неделю обязаны сдавать тест. В компаниях с количеством сотрудников от четырех до 10 человек минимум четверо из них должны еженедельно иметь отрицательный тест. Для предприятий с численностью работников более 10 человек 20% сотрудников (но не менее четырех) должны быть с тестом. Министерство здравоохранения пообещало проводить усиленные проверки на предприятиях, чтобы убедиться в соблюдении этой обязательной меры. Соответствующий декрет Минздрава был опубликован в официальном издании правительства 28 января. У него нет срока окончания.

Штрафы

Предполагается, что каждое предприятие должно составить ротационный график тестирования своих сотрудников. Работодатели, которые этого не сделают и не будут контролировать наличие тестов, понесут ответственность в виде штрафа в размере 300 евро за каждого работника, который должен был пройти тестирование в течение недели, но не прошел. Если сотрудник был проинформирован об обязательстве пройти тест на COVID-19, но не выполнил это требование, то штраф ложится на него.

Интересно, что в самом декрете говорится, что работники государственного и частного секторов «должны пройти экспресс-тест на антиген», но ни о каком обязательном графике в документе не говорится. Упоминание о графике есть только в пресс-релизе Минздрава, который, вообще-то, не имеет никакой юридической силы. Из этого некоторые юристы делают вывод, что требование к работодателям составлять графики тестирования формально недействительно.

Антиконституционное требование

Обязательное тестирование — лишь один из декретов Минздрава за все время пандемии. Адвокат Эвангелос Пургуридис считает, что принуждение здорового человека пройти медицинскую процедуру нарушает принцип физической неприкосновенности, а принуждение пройти медицинское обследование без согласия лица нарушает ст. 7 Конституции Республики Кипр и европейские соглашения, подписанные страной. Ст. 7, п.1 Конституции Республики Кипр гласит: «Каждый человек имеет право на жизнь и физическую неприкосновенность». Остальные пункты статьи не содержат никаких ограничений или пояснений этого основного утверждения. «Вы не можете подвергать человека медицинской процедуре без его согласия. Это шантаж. С юридической точки зрения это классический случай незаконного принуждения», — убежден Пургуридис.

Довести до суда

Даже если бы декрет об обязательном тестировании был технически легитимным, то есть принят парламентом, все равно можно было бы поставить вопрос о пропорциональности этой меры. «Почему здоровый человек вынужден проходить тест?», — задается вопросом Клиридис. По его мнению, нет никаких сомнений в том, что экспресс-тест — это инвазивная процедура, нарушающая физическую неприкосновенность человека. Юрист считает, что если кто-то возражает против прохождения экспресс-теста, он может отказаться, получить штраф, затем отказаться платить этот штраф и обратиться в суд, чтобы доказать, что его права были нарушены. «Прошу не воспринимать мои слова как юридическую консультацию, но именно так все и будет. Дело нужно решать в суде», — сказал Клиридис.

Общественное здоровье vs личные свободы

А вот юрист Ахиллеас Димитриадис считает, что нелегитимность декретов Минздрава еще надо доказать. Тот факт, что решения не были приняты парламентом, ни о чем не говорит. «Декреты основываются на законе о карантине. Теоретически, министр может привязать к закону любое количество своих указов. С другой стороны, такие декреты не должны быть бессрочными», — говорит Димитриадис. Он добавляет: «Когда дело доходит до таких вопросов, как те, с которыми мы сталкиваемся сегодня, нет какого-то единого и обязательного правила. Нужно рассмотреть фактический контекст, в котором вы действуете. В данном случае речь идет о балансе между общественным здоровьем и личными свободами. Например, вы бы отправили своих детей в школу, зная, что учитель не проверялся на коронавирус?». Возникают и вопросы ответственности: «Если работодатель не следит за тем, чтобы персонал делал тесты, и один работник заражается вирусом от другого, разве работодатель не несет ответственности за невозможность защитить от болезни своих сотрудников?». Тем не менее, каждый случай требует индивидуального подхода, например, чтобы ответить на вопрос, правомерно ли в принципе уравнивать школьных учителей и офисных работников.

Вред от обязательных мер

Доцент кафедры эпидемиологии и общественного здравоохранения Открытого университета Кипра Элпидофорос Сотириадис согласился с тем, что обязательное тестирование «неприемлемо», поскольку оно противоречит ряду кипрских законов и международных договоров, касающихся прав человека, например, Конвенции о защите прав и достоинства человека в связи с применением достижений биологии и медицины (сокращенно «Конвенция о правах человека и биомедицине»), международному юридически обязательному документу о защите прав человека в биомедицинской сфере. «Обязательные экспресс-тесты нарушают медицинскую этику, заставляя людей проходить медицинскую процедуру путем получения биологического образца», — добавляет Сотириадис. К тому же, эпидемиолог уверен, что принудительное тестирование, по-видимому, не оказывает никакого влияния на контроль передачи вируса в обществе. «Обязательность тестирования не подкрепляется научными исследованиями. Кроме того, обязательные тесты идут вразрез с основными принципами и ценностями общественного здравоохранения. Существуют многочисленные исследования, показывающие, что обязательные меры имеют неблагоприятные последствия в области общественного здравоохранения и часто приводят к нежелательным результатам, которые никак не влияют на контроль распространения инфекционных заболеваний, например, заставляют людей либо скрывать свой медицинский статус, либо избегать этих мер. А это, в свою очередь, приводит к искаженным данным, получаемым органами здравоохранения», — утверждает эксперт.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    Website means https://vkcyprus.com/

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

     

    6            Disclaimers

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    c any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

    8.1        You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you. For example, we may need to have your contact information in order to provide you with updates from our Website.

    9.2        On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

     

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
