Родительский отпуск на Кипре

Кто, как и в каком размере оплачивает родительский отпуск? — работодатель или государство? И какие документы для этого необходимы?

Декретный отпуск

Родительские права гарантированы «Законом о защите материнства» (№ 100 (I) / 1997) с последними поправками, внесенными Законом № 11 (I) / 2019.

Женщина, имеющая медицинскую страховку (трудоустроенная, либо просто обладающая медицинским страхованием, либо застрахованная на службе кипрского работодателя за границей) и предъявляющая свидетельство от зарегистрированного врача, в котором указывается предполагаемая неделя беременности, имеет право на декретный отпуск. Декретный отпуск предоставляется на 18 недель. За 2 недели до родов отпуск дается на 11 недель подряд. Как использовать остальное время, женщина решает сама.

Трудоустроенной женщине, которая усыновляет или принимает на попечение ребенка в возрасте до 12 лет с целью усыновления, предоставляется отпуск по беременности и родам продолжительностью 16 последовательных недель при условии, что она уведомляет работодателя за 6 недель о своем намерении.

В случае рождения более одного ребенка, право на отпуск по беременности и родам продлевается на четыре недели для каждого ребенка.

Работающая женщина, использовавшая суррогатное материнство, имеет право на отпуск по беременности и родам продолжительностью 18 недель при условии, что у нее есть постановление суда о решении завести ребенка через суррогатное материнство в соответствии с положениями «Закона 2015 о медицинской помощи при вспомогательной человеческой репродукции», а также медицинская справка от зарегистрированного врача о начале беременности.

Суррогатная или биологическая мать при этом имеет право на отпуск по беременности и родам длиной 14 недель подряд, который является обязательным со второй недели до предполагаемой недели родов.

В период отпуска по беременности и родам работник получает выплаты и пособия по беременности и родам в такой степени и на таких условиях, которые предусматривает Закон о социальном страховании. Форму для заявления на получение отпуска по беременности и родам нужно подать в местное управление социального обеспечения после ее подписания заявителем, работодателем и врачом.

Отцовский отпуск

В 2017 году вступил в силу Закон о Защите Отцовства (№ 117 (I) / 2017). В соответствии с данным законом работник, чья супруга родила или получила ребенка от суррогатной матери, либо он и его жена, усыновившие ребенка в возрасте до 12 лет, имеют право на отпуск по уходу за ребенком длиной в две последовательные недели в период 16 недель, начиная с недели рождения или усыновления.

Пособия по отцовству выплачиваются в соответствии с законами о социальном страховании. Таким образом, право на подачу заявки имеют отцы, которые внесли взносы в Фонд социального страхования.

Отец должен проинформировать своего работодателя о намерении воспользоваться правом на отпуск по уходу за ребенком в письменной форме с предварительным уведомлением за две недели, а также подать заявление в Министерство труда, социального обеспечения и социального страхования в течение 21 дня после начала отпуска.

Заявители должны представить, среди прочего, свидетельство о рождении ребенка, а также свидетельства о браке или соглашении о совместном проживании.

Данный закон применяется только к отцам, состоящим в законном браке или в гражданско-правовом партнерстве.

Пособие по материнству и отцовству

Условия выплаты пособия по беременности и родам застрахованному лицу:
• нахождение в декретном/отцовском отпуске без получения полной зарплаты от своего работодателя;
• наличие действующей базовой страховки, равной 0,50 страхового пункта. С начала страхования должно пройти как минимум 26 недель;
• наличие действующей или ассимилированной страховки, равной не менее 0,39 страхового пункта в течение соответствующего годового взноса.

Размер пособия зависит от взносов в систему социального обеспечения и выплачивается частями на банковский счет заявителя.

Пособие по материнству и отцовству состоит из базового пособия и дополнительного пособия. Еженедельная ставка пособия равна 72% от недельной стоимости пункта страхования основного страхования застрахованного лица. Еженедельная сумма базового пособия увеличивается до 80%, 90% или 100%, если у родителя есть один, два или три защищенных ребенка соответственно.

Работник (женщина или мужчина) не имеет права на получение пособия по беременности и родам или отцовству в течение периода, на протяжении которого он получает свою основную заработную плату непосредственно от своего работодателя. Если он получает только часть заработной платы, пособие уменьшается так, чтобы общая сумма пособия и его заработная плата вместе не превышали сумму основной заработной платы.

Пособие по беременности и родам

Существует также пособие по беременности и родам, являющееся единовременным пособием для женщин, которые родили во время проживания на Кипре, при условии, что они являются зарегистрированными резидентами и либо сами, либо их мужья вносят взносы в систему социального страхования. На данный момент сумма такого гранта составляет 6% от годовой базовой страховой прибыли.

Неоплачиваемый отпуск и другие форс-мажорные обстоятельства

В соответствии с Законом о родительских отпусках и отпуске по форс-мажорным обстоятельствам 2012 года (№ 47 (I) / 2012), работники любого пола, проработавшие по крайней мере шесть месяцев у одного и того же работодателя, могут претендовать на неоплачиваемый отпуск по уходу за ребенком на период до 18 недель (на каждого ребенка) в связи с рождением ребенка или усыновлением или уходом за ним.

При нормальных обстоятельствах родители, заинтересованные в отпуске по уходу за ребенком, должны письменно сообщить об этом своему работодателю за три недели.

Если родитель вдовец/вдова, он имеет право на отпуск по уходу за ребенком до 23 недель. Это право индивидуально и не подлежит передаче. Однако в тех случаях, когда один из родителей взял отпуск по уходу за ребенком минимум на две недели, он может перевести две недели из оставшейся части другому родителю.

Родители могут взять отпуск по уходу за ребенком по истечении декретного отпуска и до достижения 8-летия ребенка. В случае усыновления, отпуск по уходу за ребенком можно взять после истечения декретного отпуска и до 8-й годовщины усыновления при условии, что на момент взятия отпуска ребенку не исполнилось 12 лет. Если ребенок с ограниченными возможностями, такой отпуск можно использовать до его 18-летия.

Отпуск по уходу за ребенком можно взять как минимум на одну неделю и максимум на пять недель за календарный год при наличии одного или двух детей и на семь недель, если детей трое и более.

Кроме того, в соответствии с вышеуказанным законом, работники (как женщины, так и мужчины) имеют право на неоплачиваемый отпуск в течение семи дней в году по причине форс-мажорных обстоятельств, таких как болезнь или несчастный случай с их иждивенцами.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    1.2        If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.

     

    2            Changes

    2.1        We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are       responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the Website, you agree to be bound by the changed

    2.2        We may change, suspend, discontinue, or restrict access to, the Website without notice or liability.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

     

    6            Disclaimers

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    c any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

    d any site linked from the Website. Any link on the Website to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

    8            Privacy policy

    8.1        You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you. For example, we may need to have your contact information in order to provide you with updates from our Website.

    8.2        The personal information you provide to us is collected and may be used for communicating with you, statistical analysis, the marketing by us of products

    and services to you, credit checks (if necessary), and research and development.

    8.3        We may also collect technical information whenever you log on to, or visit the public version of, our Website. This may include information about the way

    users arrive at, browse through and interact with our Website. We may collect this type of technical information through the use of cookies and other

    9.2        On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

     

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
