О чем говорят юристы на Кипре?

«Мы живем в новой реальности» – отметил министр внутренних дел Никос Нурис, открывая юридическую конференцию Best Legal, которая прошла в Лимассоле 22-23 сентября. «На Кипре существует серьезная проблема со сроками рассмотрения судебных дел, более 50 тысяч дел ожидают своей очереди годами» – заявил председатель Кипрской коллегии адвокатов Христос Клиридис. Эти и другие темы рассмотрели участники восьмой конференции Best Legal, объединяющей юристов из разных стран, работающих на Кипре или с Кипром.

Что нужно изменить в системе?

Участники конференции обсуждали изменения, которые необходимо внести для эффективной работы окружных судов. Будут созданы новые апелляционные суды, а также Верховный Конституционный суд и два новых подразделения Верховного суда – одно из них будет заниматься уголовными делами, а второе – гражданскими. В то же время, уже создан коммерческий суд с возможностью использования английского языка в ходе слушаний и при ведении дел.

Христос Клиридис привел малоизвестные факты. Согласно нормам ЕСПЧ (Европейского суда по правам человека), дела, рассматриваемые более двух лет, считаются «зависшими». Таких дел на Кипре более 50 000. Если не трансформировать судебную систему страны, рассмотрение всех накопившихся дел займет около 20 лет. Но за это время накопятся новые.

Новая судебная реформа

Парламент Кипра в июле 2022 года, после долгих обсуждений, наконец принял поправки к законам Кипра, которые приведут к долгожданной реформе судебной системы. О реформе подробно рассказал Ставрос Павлу, юрист с 35-ти летним опытом, управляющий партнер компании Patrikios Pavlou & Associates LLC.

С 1 января 2023 года Законодательство предусматривает функционирование Верховного суда и Верховного Конституционного суда, как отдельных инстанций. Предусмотрено создание Апелляционного суда, который будет выступать в качестве второго уровня судебной системы и рассматривать апелляции судов низшей инстанции. Планируется создание Коммерческого суда, который сможет проводить судебные разбирательства на английском языке. В этом суде будут рассматриваться дела, исковые требования по которым превышают 2 млн.евро.

Кроме того, были приняты новые Гражданские процессуальные правила (CPR), которые будут регулировать ведение дел в будущем. Принятия этих правил давно ждали. Новые CPR направлены на сокращение количества в длительности процедур на уровне нижестоящих судов, теперь судебные дела будут рассматриваться быстрее.

Виды на жительство для сотрудников кипрских компаний

Новая стратегия по привлечению бизнеса на Кипр привела к тому, что довольно большое число международных компаний перенесли на остров свою штаб-квартиру. Так в 2021 году было подано 5475 заявок на получение вида на жительство для релоцированных сотрудников, а с января по август 2022 года – уже 7883. «Я уверен: инициативы и реформы правительства создадут новые возможности как для существующих, так и для новых компаний, которые намерены перенести свою деятельность на Кипр», – отметил глава МВД Никос Нурис.

Он также рассказал о пересмотренной миграционной политике, которая теперь позволяет принимать на Кипре и трудоустраивать родственников релоцированных сотрудников. В 2021 году было подано 4242 заявления на получение разрешений на проживание в рамках воссоединения семьи. За первые восемь месяцев 2022 года число таких прошений достигло 4524.

Правомерность применения антироссийских санкций и их влияние на Кипр

Одно из пленарных заседаний конференции Best Legal было полностью посвящено теме санкций. Их рассмотрели с нескольких сторон. Во-первых, соответствуют ли они европейскому и международному законодательству. Во-вторых, можно ли их оспорить в суде и в каких случаях это точно получится. В-третьих, участники конференции поговорили о том, насколько сильно санкции влияют на экономику стран ЕС и, в частности, Кипра.

Семинары и рабочие встречи

В рамках Best Legal прошли семь семинаров и тематических встреч, актуальных для кипрских юристов. В частности, обсудили трансфертное ценообразование, особенности открытия офиса в Дубае, маркетинговые стратегии для юридических фирм, создание контента и управление репутацией, цифровизацию документооборота, эффективное взаимодействие с известными международными рейтинговыми агентствами.

Кроме того, делегаты конференции могли пообщаться и обсудить результаты работы Best Legal в неформальной атмосфере вечерних мероприятий.

Следующая встреча – через год

В 2022 году конференция Best Legal прошла под эгидой Кипрской ассоциации юристов и при поддержке юридической фирмы Patrikios Pavlou & Associates LLC, группы компаний M.Target Group, компании Imperio. Организаторы конференции – деловой журнал «Успешный бизнес» и клуб руководителей бизнеса Successful Business Leaders’ Club.

    1            Application of terms

    3            Definitions

    In these Terms:

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

    10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
