Вопрос. Я гражданка России, замужем за киприотом. Есть общий ребенок (4 года). Хочу подать на развод и вернуться на родину. Но, как мне сказали, в случае расторжения брака ребенка автоматически занесут в стоп-лист. Получается, мне придется остаться на Кипре до достижения им 18-летия? Средств к существованию у меня недостаточно, т. к. здесь трудоустроиться по моей специальности очень сложно. Можно ли вместе с ребенком покинуть Кипр и, будучи в России, подать на развод?

Ситуация, когда имя ребенка помещают в стоп-лист по причине развода родителей, особенно когда один из них является иностранцем, является правовым вопросом, с которым к нам обращаются довольно часто. Ответ на ваш вопрос однозначен: да, после развода имя вашего ребенка будет включено в стоп-лист. Причина – предотвращение отъезда несовершеннолетнего с любым из двух родителей (будь то вы или ваш муж) при неосведомленности об этом другого родителя.
Поскольку вы оба будете в разводе, единственный способ защиты интересов и прав – как ваших, так и несовершеннолетнего – запрет на его выезд или наличие у одного из вас письменного аффидавита (заявления, сделанного под присягой) от одного из родителей, позволяющего ребенку путешествовать с другим родителем, с указанием страны (стран) и продолжительности поездки.
Если вы хотите покинуть Кипр и лишить вашего мужа прав на ребенка, вам придется обратиться в суд для запроса о предоставлении вам исключительных родительских прав. В такой ситуации вы должны будете доказать, что ваш муж не может обеспечить уход за своим ребенком и вредит его интересам. Сделать это нелегко, поскольку суду необходимо представить конкретные доказательства. Это связано с тем, что решение принимается в интересах несовершеннолетнего, а не кого-либо из родителей. Без этого вам не разрешат забрать с собой ребенка и улететь в Россию.
Вам придется инициировать процедуры для получения развода здесь, на Кипре, и если вы захотите улететь с вашим ребенком за границу, вы должны будете получить письменное согласие от вашего мужа.
В любом случае, процедура развода не будет единственной, которую необходимо осуществить: суд также определит будущее место жительства несовершеннолетнего.
Кроме того, по вопросу приобретения исключительных родительских прав вам следует проконсультироваться с юристами.

Вопрос. Я гражданка Украины и живу на Кипре уже три года. Есть ребенок от киприота, рожденный вне брака, но признанный гражданином Кипра через суд. Отцовство установлено посредством анализа ДНК. В настоящий момент я опять беременна от того же мужчины. Срок уже восемь месяцев, но отец ребенка совершенно не желает ничем помогать. Я обратилась в службу социальной помощи 1,5 месяца назад. Они обещали помочь, но до сих пор ничего не сделали. Куда мне можно обратиться в моей ситуации?

Согласно положениям Закона 216/1990, родительская ответственность за ребенка, родившегося и живущего вне брака родителей, принадлежит матери. Однако если отец признает ребенка своим, то у него также появляются родительские права и обязанности.
Тот факт, что отец вашего первого ребенка признал его своим, еще не создает никаких юридических обязательств для признания им второго ребенка.
Так как ваш ребенок будет рожден вне брака и биологический отец отказывается признавать его своим, родительская ответственность и опека будут вашими исключительными правам и обязанностями.
Таким образом, для осуществления своих законных прав вам важно подать заявление в Суд по семейным делам вашего муниципалитета для судебного признания вашего ребенка в соответствии с положениями Закона 187/1991 (статьи 15, 20, 21 и 22). Оно подается в отношении родителя, который отказался признавать биологическое отцовство добровольно. Оно может быть представлено как вами (не позднее, чем через пять лет после рождения ребенка), так и самим ребенком, но не позднее, чем через три года после достижения им 18-летнего возраста.
Если суд вынесет решение об установлении отцовства, то второй родитель будет обязан исполнять свои обязанности.
Государственный орган, в который вы можете обратиться за помощью, – Служба социального обеспечения. Там подготовят социально-экономический доклад в целях предоставления суду важной информации, что впоследствии позволит вынести наилучшее решение в интересах ребенка.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
