Закон об управлении многоквартирными домами: у должников будут проблемы

Многоквартирные дома на Кипре

Власти хотят решить хроническую проблему долгов за общедомовые расходы, из-за которых дома остаются без денег на лифты, ремонт и обслуживание, а за неплательщиков фактически несут расходы соседи. Новая система затронет владельцев и жильцов десятков тысяч многоквартирных комплексов на Кипре.

10 сентября парламентский комитет по внутренним делам вновь обсуждал реформу управления такими зданиями. Она предусматривает новый надзор за управляющими комитетами, реестр зданий, резервные фонды и новые механизмы взыскания общедомовых платежей. Однако заработает система не сразу: на ее подготовку может потребоваться до двух лет.

 

Когда один сосед не платит, без лифта остается весь дом

На заседании парламента прозвучали истории, показывающие, к чему на практике приводят долги по общедомовым расходам.

Представитель Кипрской ассоциации предпринимателей в сфере недвижимости Василис Артемиу рассказал о матери, которой приходится носить малолетнего ребенка и коляску на руках до третьего этажа, поскольку один из собственников отказался платить свою долю расходов. Другой пример – 75-летняя женщина с астмой, для которой проблемы с лифтом превратились уже не просто в бытовое неудобство.

По оценке представителей отрасли, в объектах совместной собственности живут 250 000–300 000 человек.

Проблема не в том, что обязанности платить сейчас вообще не существует. По действующим правилам собственники уже должны участвовать в расходах на страхование, содержание, ремонт, восстановление и управление общей собственностью. Доля расходов определяется в соответствии с правилами здания исходя из площади каждой единицы. Это прямо указывает Департамент земель и кадастра Кипра.

Однако на практике взыскание долгов может быть долгим и сложным, а нехватка денег отражается на всем доме – от уборки и электричества в общих помещениях до обслуживания лифта и серьезного ремонта.

 

Что собираются изменить

Главное изменение – появление полноценной системы надзора за совместной собственностью. Предполагается создать службу регистрации таких зданий и контроля за управляющими комитетами. Эти полномочия планируется передать районным организациям местного самоуправления – EOA (Επαρχιακοί Οργανισμοί Αυτοδιοίκησης).

Для зданий должен появиться электронный реестр. Новая цифровая система будет связана с данными земельного кадастра и системой Ippodamos. Государство согласилось профинансировать создание соответствующей IT-платформы.

Кроме того, для каждого здания предполагается обязательный резервный фонд. Размер взносов будет определять управляющий комитет, а накопленные средства предназначены для ремонта, обслуживания и проверок безопасности здания. Это одна из ключевых норм, которую описывает Министерство внутренних дел Кипра.

Законопроект также предусматривает более четкое разделение расходов. В них входят, в частности, уборка общих помещений, обслуживание лифтов, электричество и вода в общих зонах, страхование, ремонт здания, сантехнических и электрических систем и другие общедомовые затраты.

 

Продать квартиру с долгами станет сложнее

Одна из наиболее существенных для владельцев квартир норм касается продажи недвижимости.

По плану МВД, для передачи или продажи квартиры потребуется подтверждение отсутствия задолженности по общедомовым расходам, которое выдает управляющий комитет. Таким образом, собственник с неоплаченными общими расходами сначала должен будет урегулировать задолженность. МВД Кипра прямо называет такое подтверждение необходимым условием передачи или продажи квартиры.

Это должно дать управляющим комитетам рычаг, которого им сейчас зачастую не хватает: долг нельзя будет просто годами оставлять нерешенным, а затем продать объект, переложив проблему на других.

 

Управляющий комитет должен быть в каждом доме

Сам принцип обязательного управления совместной собственностью для Кипра не новый. Департамент земель и кадастра указывает, что каждое зарегистрированное здание совместной собственности должно иметь управляющий комитет. Если его нет, любой собственник квартиры может обратиться за процедурой его назначения.

Новый закон должен сделать эту систему значительно более контролируемой. ETEK – Научно-техническая палата Кипра – настаивает, в частности, на четырех элементах: наличии управляющего комитета в каждом здании, своевременной уплате общих расходов, реально работающем резервном фонде для ремонта и обслуживания и быстром недорогом внесудебном механизме разрешения небольших финансовых споров.

Предлагаемый надзорный орган также должен получить возможность применять административные меры к управляющим комитетам и собственникам, нарушающим требования законодательства. Почему закон до сих пор не приняли

Реформа обсуждается уже несколько лет. Один из главных споров заключался в том, кто именно должен контролировать многоквартирные здания и за чей счет будет работать новая система.

Районные организации местного самоуправления первоначально возражали против передачи им новых полномочий. Они указывали, что для этого потребуются сотрудники, финансирование, доступ к кадастровым данным и отдельная цифровая инфраструктура. Еще в 2025 году EOA предупреждали, что не готовы принять такую функцию без необходимых ресурсов.

Теперь позиции МВД и большинства EOA сблизились. На заседании 10 сентября представители местных органов власти заявили о готовности принять полномочия при выполнении ряда условий. Среди них — достаточное количество сотрудников, адекватные сборы для финансирования работы службы, электронные реестры зарегистрированных и незарегистрированных объектов и полноценная IT-система. Исключением остается EOA Фамагусты, который продолжает возражать против передачи этих функций районным организациям.

3            Definitions

In these Terms:

including and similar words do not imply any limit

Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

personal information means information about an identifiable, living person

Terms means these terms and conditions titled Terms and conditions of use

Underlying System means any network, system, software, data or material that underlies or is connected to the Website

We, us or our means VESTNIK KIPRA Group

You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

 

4            Your obligations

4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

information remains true, current and complete.

4.2        You must:

a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
 

5            Intellectual property

We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

10         General

10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

Republic of Cyprus.

Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

Website.

10.3      For us to waive a right under these Terms, the waiver must be in writing.

10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

severed from these Terms. The remainder of these Terms will be binding on you.

10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
