Новые часы, дорогая сумка или крупная сумма наличными в ручной клади или багаже могут превратить обычное прохождение аэропорта в продолжительное разбирательство с таможней. Причем заплатить иногда приходится значительно больше, чем стоила попытка пройти незамеченным.
Поводом вновь напомнить пассажирам о таможенных правилах стал недавний случай в аэропорту Ларнаки. Сотрудники Таможенного департамента обнаружили в багаже прибывшего из Швейцарии пассажира трое незадекларированных наручных часа общей стоимостью около 57 тысяч евро. Помимо причитающихся пошлин и налогов на сумму 10 843 евро, ему назначили штраф и дополнительное денежное взыскание в размере 4584 евро.
Однако декларировать необходимо не только предметы роскоши. Правила зависят прежде всего от того, откуда прибывает пассажир – из государства Европейского союза или из третьей страны.
Пассажиры, прибывающие на Кипр из страны, не входящей в ЕС, могут беспошлинно ввозить товары для личного или семейного использования либо в качестве подарков, если их общая стоимость не превышает 430 евро на человека при путешествии воздушным или морским транспортом. Для пассажиров младше 15 лет лимит составляет 175 евро.
Речь идет не только об электронике или ювелирных изделиях. В расчет могут входить часы, сумки, одежда, телефоны, компьютеры, косметика и другие новые покупки. Если стоимость одного неделимого предмета превышает установленный лимит, нельзя просто вычесть из нее 430 евро: такой товар необходимо заявить таможне целиком.
Важно сохранять чеки или иные документы, подтверждающие цену. При их отсутствии таможенные органы вправе самостоятельно определить таможенную стоимость товара.
Личные вещи, которыми пассажир пользовался до поездки и которые он временно возвращает на Кипр, обычно не рассматриваются как новая покупка. Однако дорогие часы, украшения, фотооборудование или техника без следов использования и без подтверждения их прежнего приобретения могут вызвать дополнительные вопросы.
Лимит в 430 евро не отменяет количественных ограничений на подакцизные товары. Для пассажиров, прибывающих из-за пределов ЕС, беспошлинные нормы включают, в частности:
– до 200 сигарет, либо 100 сигарилл, либо 50 сигар, либо 250 граммов курительного табака;
– до 1 литра крепких алкогольных напитков крепостью свыше 22%, либо до 2 литров напитков крепостью не более 22%;
– дополнительно – до 4 литров вина и до 16 литров пива.
Льготы на алкоголь и табак не предоставляются пассажирам младше 17 лет. Официальные правила для пассажиров опубликованы Таможенным департаментом Кипра.
При прибытии из другой страны ЕС товары, приобретенные для личного потребления, как правило, не облагаются повторно налогами на Кипре. Но если количество алкоголя или табака выглядит коммерческим, таможня может потребовать доказать, что продукция действительно предназначена для личного использования, а не для перепродажи.
Каждый, кто въезжает на Кипр или покидает его с наличными на сумму 10 000 евро или более (либо эквивалентной суммой в любой другой валюте), обязан подать таможенную декларацию. Это правило распространяется и на комбинацию разных валют, если их общая стоимость достигает установленного порога.
Под «наличными» понимаются не только банкноты и монеты. В правила также включены некоторые оборотные инструменты на предъявителя, например дорожные чеки, а в определенных случаях – инвестиционные золотые монеты и слитки. В декларации необходимо указать владельца денег, их происхождение, предполагаемого получателя и цель использования.
Таможня может проверить самого пассажира, его багаж и транспорт, а также временно задержать деньги, если декларация отсутствует, заполнена неверно либо имеются признаки связи средств с преступной деятельностью. Проверка возможна и при сумме менее 10 тысяч евро, если возникнут соответствующие подозрения.
За нарушение правил контроля наличных при пересечении внешней границы ЕС предусмотрены штраф до 100 тысяч евро, лишение свободы на срок до трех лет либо оба наказания одновременно.
Отдельную категорию составляют товары, которые нельзя свободно ввозить даже после уплаты налогов. Таможенный департамент Кипра относит к запрещенным или ограниченным предметам, среди прочего:
– наркотические и психотропные вещества;
– оружие, боеприпасы и взрывчатые вещества;
– поддельные и пиратские товары;
– отдельные лекарства;
– растения, семена, мясные и молочные продукты;
– животных и продукты животного происхождения;
– археологические предметы и культурные ценности;
– некоторые виды животных, растений и изделий из них, подпадающие под правила защиты редких видов.
Перечень не является исчерпывающим: для ряда предметов требуется лицензия, ветеринарный или фитосанитарный сертификат либо разрешение другого компетентного ведомства.
Особую осторожность следует проявлять с лекарствами. Препарат, свободно продающийся в одной стране, на Кипре может относиться к контролируемым веществам. Желательно иметь рецепт или медицинскую справку, а перед поездкой проверить требования кипрских органов.
Проход через зеленый коридор фактически означает заявление пассажира о том, что у него нет товаров, подлежащих декларированию, а также запрещенных или ограниченных предметов.
Если пассажир везет товар дороже разрешенного лимита, крупную сумму наличных, коммерческую партию, оружие, контролируемые лекарства или просто сомневается в правилах, следует выбрать красный коридор и обратиться к сотруднику таможни.
Кипрское законодательство прямо предусматривает обязанность пассажиров, прибывающих из третьих стран, предъявлять багаж для проверки и заявлять о находящихся в нем товарах.
Обнаружение незадекларированной покупки не ограничивается начислением обычных налогов. Пассажиру могут потребоваться:
– уплата всех таможенных пошлин, НДС и акцизов;
– выплата административного штрафа или суммы, назначенной для внесудебного урегулирования дела;
– передача или временное изъятие товара;
– конфискация товара;
– уголовное преследование.
Размер взыскания зависит от стоимости и вида товара, суммы неуплаченных налогов, обстоятельств нарушения и того, сочтет ли таможня действия умышленной попыткой уклониться от платежей.
Согласно Таможенному кодексу Кипра, мошенническое уклонение от уплаты пошлин или налогов может повлечь штраф в размере до трехкратной стоимости товара, лишение свободы на срок до трех лет либо оба наказания. За заведомо или по неосторожности ложные сведения в существенной части декларации также предусмотрено до трех лет заключения.
Товары, связанные с уклонением от уплаты налогов или ввезенные с нарушением установленного порядка, могут быть задержаны и обращены в доход государства.
При этом не каждый случай автоматически заканчивается судом. Директор Таможенного департамента вправе при определенных условиях урегулировать таможенное правонарушение во внесудебном порядке, приняв денежную выплату. Именно поэтому в сообщениях ведомства нередко отдельно указываются начисленные налоги и дополнительная сумма, уплаченная нарушителем для закрытия дела.

3 Definitions
In these Terms:

Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis
personal information means information about an identifiable, living person
Terms means these terms and conditions titled Terms and conditions of use
Underlying System means any network, system, software, data or material that underlies or is connected to the Website

You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.
4 Your obligations
4.1 You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the
information remains true, current and complete.
4.2 You must:
a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and
b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.
4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.

Republic of Cyprus.
Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the
Website.
10.3 For us to waive a right under these Terms, the waiver must be in writing.
10.4 Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.
10.5 If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent
required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as
severed from these Terms. The remainder of these Terms will be binding on you.
10.6 These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or
agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not
expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
