Электронная подпись: все, что нужно знать

Долгожданная цифровизация нагрянула на Кипр неожиданно и во многом оказалась спровоцирована пандемией коронавируса. Такие словосочетания как «электронная идентификация личности» и «цифровая подпись» все чаще становятся темами новостей. Для того чтобы держать жителей острова в курсе грядущих изменений, Подминистерство исследований, инноваций и цифровой политики опубликовало ответы на самые популярные вопросы о том, какие именно нововведения ждут нас до конца года и как они помогут облегчить нашу жизнь.

Что такое электронная идентификация личности (eID)?

Электронная идентификация личности – это официальное государственное средство идентифицирования гражданина и осуществления безопасных и законных электронных транзакций. Это своего рода электронный паспорт гражданина в цифровом мире, равноценный биометрическому паспорту в мире физическом. Кроме того, eID обеспечивает безопасное и законное использование авторизованной электронной подписи.

Что себой представляет Национальный план электронной идентификации личности?

План включает в себя основные принципы, которые регламентируют выдачу eID (на основании европейской директивы №910/2014 eIDAS). Этот план состоит из законопроектов, предложенных Департаментом регистрации населения и миграции и Департаментом электронных коммуникаций, а также включает в себя техническую документацию Департамента информационных услуг. Данные законопроекты переданы в Юридическую службу Республики Кипр для экспертной оценки.

Реализация национального плана даст возможность сделать доступ к электронным системам, подписанию цифровых документов и развитию новых цифровых услуг единым и безопасным.

Почему на настоящем этапе вводят только цифровую подпись, но не электронную идентификацию личности?

Потому что та часть плана, которая касается электронной подписи, с 2018 года имеет законодательную базу. Цифровая подпись будет введена на период в один год, чтобы граждане могли применять ее при подаче электронных заявлений, контрактов. Когда завершится правовая регламентация электронной идентификации личности, тогда граждане получат доступ к eID, изначально на три года.

Что такое подтвержденная электронная подпись?

Согласно европейскому законодательству, подтвержденная электронная подпись (или просто электронная подпись) это зашифрованная запись, состоящая из цифр и букв. Она выдается аккредитованным поставщиком этой услуги и представляет собой современный вид подписи, который используется в архивах, документообороте, тендерах. Это средство, которое гарантирует аутентичность документа и предоставляет защиту от изменений любого рода. Электронная подпись имеет ту же законную силу, что и собственноручная подпись. Ее важные характеристики:

– уникальный способ отождествления подписанта и подписи;

– полный контроль ее применения со стороны владельца подписи;

– возможность отслеживать любые изменения в подписанном документе.

Чем не является электронная подпись?

Она не является отсканированной собственноручной подписью или подписью, которую оставляют с помощью стилуса на экране электронного устройства.

Существует ли на Кипре аккредитованный поставщик услуги электронной подписи?

Да, это компания JCC Payment Services Ltd, которая внесена в реестр Евросоюза.

Как я могу сделать электронную подпись?

Обратитесь в свой банк. В случае, если банк не сможет вас обслужить, напишите или позвоните в компанию JCC напрямую. Стоит отметить, что банки пока что находятся на этапе планирования и развития соответствующих сервисов.

Сколько времени требуется для получения электронной подписи?

Около трех рабочих дней, но этот срок может отличаться в зависимости от организации, где вы делаете подпись.

Как ей пользоваться?

Вы сможете пользоваться ей там, где возможно применение цифровой подписи. Поставить электронную подпись можно будет через специальное приложение на смартфоне.

Можно ли будет скачать это приложение на любое устройство?

Да, его будут поддерживать компьютеры, смартфоны и планшеты.

Сколько времени будет действовать электронная подпись?

На первоначальном этапе она будет действовать один год. Когда завершатся необходимые законодательные процедуры, электронная идентификация личности будет действовать три года.

Можно ли будет отозвать электронную подпись или прекратить ее действие?

Владелец цифровой подписи имеет право отозвать свою подпись или ограничить срок ее действия следующими способами:

– через портал https://trust.jcc.com.cy/ или по телефону +357 22 868500 (круглосуточно).

Насколько безопасно использовать и хранить электронную подпись?

Создание электронной подписи следует стандартам безопасности, закрепленным в законе на общеевропейском уровне.

Где я смогу использовать цифровую подпись?

При подписании контрактов, документов, заявок и в целом при любой операции, где требуется собственноручная подпись и ваше физическое присутствие.

Какова выгода правительства, компаний и граждан?

Электронная подпись упрощает процедуры, которые теперь можно осуществлять в электронном формате, в любой момент времени и из любого места, без необходимости физически присутствовать при подписании. Существенно сократится время на обслуживание граждан и нагрузка на госсектор, организации и компании, увеличится экономия ресурсов (топлива, бумаги, расходных материалов).

Могу я попросить о создании электронной подписи для третьего лица?

Нет, каждый гражданин должен получить электронную подпись лично, без посредников и представителей.

В государственных ведомствах, банках и иных организациях можно будет пользоваться одной и той же электронной подписью или в каждом случае надо создавать разные?

Можно будет пользоваться одной и той же. Каждому гражданину нужна будет только одна электронная подпись.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    Website means https://vkcyprus.com/

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

     

    6            Disclaimers

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    c any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

    8.1        You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you. For example, we may need to have your contact information in order to provide you with updates from our Website.

    and services to you, credit checks (if necessary), and research and development.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
